LIABILITY & INSURANCE DISCLOSURE OF SARAH LOGISTICS

1. Introduction

SARAH GILL LOGISTICS LTD (“the Company”) maintains appropriate insurance arrangements and operational risk controls in accordance with UK law and industry standards.

This page provides a summary of the Company’s insurance cover and explains how liability is managed in connection with transport and logistics services.

This disclosure is provided for transparency only and does not amend, replace or override the Company’s Terms & Conditions of Transport Services. In the event of conflict, the formal Transport Terms shall prevail.

All insurance arrangements remain strictly subject to insurer policy terms, conditions, exclusions, warranties and endorsements.



2. Goods in Transit Insurance (GIT)

The Company maintains Goods in Transit insurance with a limit of:

£50,000 per vehicle


2.1 Scope of Cover

This policy is designed to cover physical loss of or damage to goods whilst in the Company’s custody and control during transit within the geographical limits stated in the insurance policy.


2.2 Limit of Indemnity

The maximum indemnity under this cover is £50,000 per vehicle unless otherwise agreed in writing prior to transport.

The Company does not provide unlimited cover.


2.3 Customer Declaration Obligation

The Customer must declare:

  • The accurate nature of goods

  • Full replacement value

  • High-risk or fragile goods

  • Goods exceeding insured limits

Failure to declare accurate information may invalidate or limit insurance recovery.

The Company shall not be liable for undeclared or misdeclared goods.



3. Public Liability Insurance

The Company maintains Public Liability insurance of:

£5,000,000

This cover protects against legal liability for accidental bodily injury to third parties or accidental damage to third-party property arising from business operations.

This cover does not extend to:

  • Purely economic loss

  • Contractual penalties

  • Liquidated damages

  • Indirect or consequential loss



4. Employers’ Liability Insurance

The Company maintains Employers’ Liability insurance of:

£10,000,000

This cover is maintained in compliance with UK statutory requirements and applies to employees engaged in Company operations.



5. Subcontractors

The Company primarily operates through its internal fleet and drivers.

Where operationally required, subcontractors may be appointed.

In such cases:

  • Subcontractors must maintain appropriate insurance cover.

  • Reasonable due diligence is undertaken.

  • Liability remains subject to the Company’s contractual terms and applicable insurance limits.



6. Excluded & Restricted Goods

Unless agreed in writing, the Company does not accept liability for:

  • Hazardous or explosive materials

  • Illegal goods

  • Precious metals, jewellery or currency

  • Fine art

  • Perishable goods (unless agreed)

  • Live animals

  • Goods requiring specialist temperature control

Carriage of restricted goods without disclosure may invalidate insurance.



7. Indemnity Clause

The Customer shall indemnify and hold harmless SARAH GILL LOGISTICS LTD against any loss, damage, liability, cost or expense (including legal fees) arising from:

  • Misdeclaration of goods

  • Inaccurate valuation

  • Failure to disclose hazardous or restricted goods

  • Inadequate packaging

  • Breach of statutory regulations

  • Customer negligence

This indemnity shall survive termination of any contract.



8. Customer Warranty Clause

The Customer warrants and represents that:

  • All goods are lawful and compliant with UK regulations.

  • Accurate information has been provided regarding value, weight and nature of goods.

  • Goods are suitably packaged for road transport.

  • No dangerous or prohibited goods are included unless declared and accepted in writing.

The Company relies on these warranties when accepting bookings.

Breach of warranty may invalidate insurance and limit Company liability.



9. Chargeback Protection Clause

Where payment is made by card or electronic method:

  • The Customer agrees not to initiate unjustified chargebacks.

  • Any disputed transaction must first be raised directly with the Company.

  • The Company reserves the right to recover costs incurred as a result of unjustified chargebacks, including administrative and legal costs.

Where services have been rendered in accordance with agreed terms, the Company shall be entitled to full payment.



10. Limitation of Liability

To the fullest extent permitted by law:

  • Liability for loss or damage to goods is limited to the insured value or declared value (whichever is lower).

  • The Company excludes liability for indirect, incidental or consequential loss.

  • Loss of profit, business interruption, reputational damage and contractual penalties are excluded.

  • Delays caused by events beyond reasonable control shall not give rise to compensation.

Nothing excludes liability for death or personal injury caused by negligence where unlawful.



11. Claims Procedure

To protect insurance validity:

  1. Claims must be notified in writing within 48 hours of delivery.

  2. Supporting documentation must be provided.

  3. Damaged goods must be retained for inspection.

  4. Claims are subject to insurer approval and policy conditions.

Failure to comply may prejudice the claim.



12. No Guarantee of Insurance Recovery

Insurance details on this page are summary information only.

The Company does not guarantee:

  • That all claims will be accepted

  • That insurers will approve every claim

  • That full recovery will be available in all circumstances

Recovery is subject to insurer decision and policy compliance.



13. Legal Status of This Page

This page:

  • Does not vary formal Transport Terms

  • Is governed by the laws of England and Wales
